Foreign Legal Aid Center 외국인법률지원센터

1. Background

From 2017 the exchanges between the NGLF and the Embassy of the Kyrgyzstan Republic to Korea have revealed the need of a Legal center for helping Kyrgyz when there are in difficulty. Starting from that point, efforts have been made to strengthen the link between Korea (Represented by the NGLF and the National Assembly Social Contribution Research Group) and the Republic of Kyrgyzstan (represented by its Embassy here in Seoul). In June 2018, a delegation of five (5) people composed of Labor Attorney, professor of international relationship from Chungnam National University, Executive secretary; the president of the certified professional labor, visited Kyrgyzstan to meet government officials and discussed how both countries can help each other and an agenda has been elaborated.

Following this event, the Foreigners Legal Aid Center was established in August 2018 with the aim to support not only Kyrgyz’s but all foreigners residing in South Korea in their difficult legal situations.

2. Goals

Our vision is to contribute to building a safe and fair society, no matter what nationality the one belongs.

Our mission is to offer a legal consultation service for foreigners residing in South Korea in different fields of law including civil law, administrative law, criminal law, real estate law, family law, etc.

3. Methods

We are honored to be able to stand among many other legal support centers, that have a long history and who have already obtained a credit of people through their hard work. Thus, we will be counting on their help by playing the role of a bridge between them and the people in need of their support. However, we possess special features that can make us different from other centers:

① The legal service we offer is provided by qualified Korean lawyers as well as by involvement of foreign lawyers. Thus, the applicant can count on both legal qualification and translation skills of native speakers.

② In our Center, we hold legal research works based on the cases we have already dealt with and as well as an analysis of the practice of law in South Korea.

③ We provide legal consultations in 8 different foreign languages: Korean, English, Russian, Spanish, French, Uzbek, Kyrgyz, and Turkmen.

④ The legal consultation is provided in 4 different methods: 1. by visiting; 2.by phone; 3. by online Q&A; 4. by video calling.

At the beginning of every month, we organize a free consultation for foreigners residing in Korea with Korean lawyers and administrative officers. After the date of the free consultation is set, we leverage the power of social media and foreigners communities in Korea to advertise our event. The applicants fill the consultation form on our website and we contact them to have the details and then we decide whether they should come to our office or have their issues get solved over phone or email.

4. Results

After the Foreigners Legal Aid Center Opens its doors in early August, many activities have been done and can be listed as below:

① Training and workshop for foreign specialists

From September 1st to September 3rd, 2018 there was held a special workshop, designated to enhance the knowledge of the foreign lawyers. Apart from acquiring new knowledge and skills in the field, the participants of the workshop could enjoy the beautiful nature of Jin-cheon region.

The main lecturer of the workshop was Lee Hoon, a well-known specialist in the sphere of Labor Law in South Korea. 3 foreigners studying law in Korea have been part of this workshop where they learn the basics of labor law in Korea.

② Recruitment of volunteers

Foreigners Legal Aid Center (FLAC) proceed to recruit volunteers for pro bono activities with a legal education background. The eligibility criteria were to be Student in Law major, Professional practicing Law, or being fluent in at least Korean and a foreign language to serve as an interpreter for those who do not have law backgrounds.

③ Website creation

To successfully promote our services and have a visibility, a website has been created. This website serves as a platform to share contents on useful legal Information such as immigration law, visa, and legal consultation centers. Anyone can just reach us and apply for a legal consultation just by filling a form on our website.

④ New partnerships

In order to expand our horizon and make more people benefit from the Legal Aid Center, we have visited many Embassies to partner with them. These embassies are Latvia, Colombia, Azerbaijan, Ukraine, Kazakhstan, Paraguay, Nicaragua, Bolivia, Honduras, and Ecuador. While the Embassies appreciated the fact that we are running such a program to help foreigners in Korea, some of them suggested holding the next FLAC event in their Embassy.

⑤ First free Legal consultation

The first free consultation of foreigners with Korean lawyers has been held on November 3rd in the office of the FLAC in Yeo-I do from 2 pm to 5 pm and had the participation of 2 Korean lawyers, 4 foreign students, and 3 interpreters to facilitate the conversation between the students and the lawyers. Most of the issues the students had were related to visa and sojourn.

⑥ Second free legal consultation

The second free consultation was held in the Embassy of Kyrgyz Republic to Korea on December 08th from 2 pm to 5 pm. Unlike the 1st consultation, this time both lawyers and Administrative officers were there to provide visa related information to the applicants who are mainly from Kyrgyzstan. Since the event is held in an Embassy, other foreigners were not allowed to have access unless there are interpreters and consequently those from other nationality receive an answer for their request via email after the representative discuss their issues with the qualified administrative officers. 7 people received legal consultation; 3 people onsite and the 4 others via email and phone call. The main issues were also related to visa and working in Korea; however, there was a case of unpaid wage.

5. Conclusion and future plans

The Foreign Legal Aid Center provides foreigners who cannot afford to hire a lawyer or pay for a legal consultation to have free services. While keeping in mind the satisfaction of the foreigners who use our services, we continually improve the quality of our service by recruiting more lawyers, administrative officers, labor attorneys and provide a large range of translation through our volunteer interpreter network.

We will continue the event once a month for foreigners needing help. In the future, we are planning a free medical support project with the help of Korean medical experts. To this end, we will invite all those who are willing to help us to explain our intentions, and we will continue to create projects that challenge nationality and challenge social problems. We hope that all foreigners living in a wonderful country like Korea will stay happy and make memories that can not be forgotten!

2017년 9월 주한키르기스스탄대사관을 통해 한국거주 키르기스스탄 사람들을 돕는 법률지원센터의 필요성을 인식했다. 이때부터 국회연구단체 국회사회공헌포럼과 차세대리더포럼에서 국가 간 상호우호협력 및 공동의 이익도모를 위해 상호교류 어젠다를 찾기 시작했다.

2018년 6월 국회사회공헌포럼 총괄, 한국공인노무사회 연구이사, 한국직업자격학회 회장, 충남대학교 국제협력 교수 등이 키르기스스탄을 방문해 정부 관계자들을 만나 양국이 서로를 도울 수 있는 의제를 상세하게 논의하였다.

이후 2018년 8월 언어적인 장벽 등으로 법률의 보호를 받지 못하고 사각지대에 놓여있는 외국인이 쉽게 무료법률상담을 받을 수 있도록 법률전문가들의 도움을 받아 외국인법률지원 프로젝트를 시작하게 되었다.

2. 목적

외국인 법률지원센터는 어떤 국적이든 사람들이 안전하고 공정한 사회를 만드는 것이 목적입니다. 주요업무는 한국에 거주하는 외국인들에게 민법, 행정법, 형법, 부동산법, 가족법 등 다양한 분야의 법률 상담 서비스를 제공하는 것 입니다.

3. 방법

도움이 필요한 외국인들을 지원하는 주요센터나 다른 법률지원센터를 연결하여 외국인들이 더 많은 지원과 정보를 얻을 수 있도록 도움을 드립니다.

또한 다른 센터와 차별화할 수 있는 콘텐츠를 갖추고 있습니다.

① 외국인법률지원센터에서 제공하는 법률 서비스는 자격을 갖춘 한국인 변호사들과 외국인 변호사들이 상담을 진행하여, 원어민의 법적 자격과 번역 능력을 모두 신뢰할 수 있습니다.

② 저희 센터에서는 주요 사례와 한국의 법률 실무 분석을 바탕으로 한 법률 연구를 진행하고 있습니다.

③ 다양한 언어 (한국어, 프랑스어, 러시아어, 아랍어, 우즈벡어, 키르기즈어, 스페인어, 투르크멘어)가 지원되어 자국의 언어로 담당 변호사에게 편리하게 상담을 받을 수 있습니다.

④ 상담방법은 센터방문상담, 전화상담, 영상통화상담, 온라인 Q&A 상담으로 이루어져있어 지역과 시간에 구애 받지 않고 여러 방법으로 법률상담을 받을 수 있습니다.

매월 초에 우리는 한국에 거주하는 외국인들을 위해 한국의 변호사나 노무사, 행정사가 무료 상담을 합니다. 무료 상담 일정 받은 후에, 우리는 소셜 미디어와 한국의 외국인 커뮤니티를 통해 우리의 행사를 광고합니다. 지원자들은 우리 웹사이트에 상담서를 작성하고 우리는 그들에게 자세한 내용을 문의한 다음 그들이 우리 사무실로 올 것인지 아니면 그들의 문제가 전화나 이메일로 해결될 것인지를 결정합니다.

4. 결과

외국인 법률지원센터가 8월 초에 문을 연 후, 많은 활동들이 행해졌고, 내용은 다음과 같습니다.

1) 외국인 변호사들을 위한 위크숍

2018년 9월 1일부터 9월 3일까지, 외국인 변호사들의 지식을 강화하기 위한 특별 워크숍이 열었습니다. 새로운 법적지식과 기술을 습득하는 것 외에도, 워크숍 참가자들은 충북진천 지역의 아름다운 자연을 즐길 수 있었습니다. 워크숍의 주 강사는 한국의 노동법 분야에서 잘 알려진 이훈 노무사님이었습니다. 한국에서 법을 공부하는 3명의 외국인들이 한국에서 노동법의 기초를 배우는 계기가 되었습니다.

2) 자원 봉사자 모집

외국인 법률지원센터(FLAC)는 법률교육 배경이 있는 프로보노 활동을 위한 자원봉사자를 모집하는 작업을 진행했습니다. 자격 기준은 법학 전공 학생, 전문직 종사자 또는 법과 관련된 경력이 없는 사람들 중 언어능력이 유창한 학생이었습니다.

3) 새로운 파트너십

우리의 시야를 넓히고 더 많은 사람들이 법률지원센터에서 혜택을 받도록 하기 위해, 주한외국대사관을 방문했습니다. 이들 대사관은 키르기스스탄, 라트비아, 콜롬비아, 아제르바이잔, 우크라이나, 카자흐스탄, 파라과이, 니카라과, 볼리비아, 온두라스, 에콰도르 등 입니다. 대사관측은 우리가 한국에 있는 외국인들을 돕기 위해 그러한 프로그램을 운영하고 있다는 점을 높이 평가했습니다.

• 첫 번째 무료 법률 상담

11월 3일 오후 2시부터 5시까지 FLAC 사무실에서 외국인과 한국 변호사와의 첫 무료법률상담 열었습니다. 학생과 변호사간의 대화를 용이하게 하기 위해 한국인 변호사 2명과 상담 받을 외국인 학생 4명, 통역 3명의 참여했습니다. 학생들이 가졌던 대부분의 문제들은 비자나 체류와 관련된 내용 이었습니다.

• 두 번째 무료 법률 상담

12월 8일 오후 2시부터 5시까지 주한키르기스스탄대사관에서 열었습니다. 첫 번째 상담에서 비자나 체류관련 상담이 많아 이번에는 변호사 2명과 행정사 2명이 키르기스스탄 사람들에게 비자 관련 정보를 제공하고 상담을 했습니다. 대사관에서 상담이 이루어졌기 때문에, 다른 국적의 외국인 출입이 어려워 다른 국적 가진 사람들은 이메일로 그들의 상담요청에 대한 답변을 받을 수 있었습니다. 총 7명이 법률상담을 받았습니다. 3명은 대사관에서, 나머지 4명은 이메일과 전화로 상담을 받았습니다. 주요 이슈는 비자 및 한국에서의 근무 관련이 있었지만, 임금체불의 경우도 있었습니다.

5. 결론과 앞으로 계획

외국법률지원센터는 변호사를 고용할 수 없거나 언어 등의 장벽으로 법률서비스를 받을 수 없는 외국인들에게 무료법률상담을 합니다. 우리의 서비스를 이용하는 외국인들의 만족을 위해, 우리는 법률전문가인 변호사, 행정사, 노무사들을 더 많이 모집함으로써 서비스의 질을 지속적으로 향상시키고, 외국인 유학생 네트워크를 통해 광범위한 통역, 번역 서비스를 제공합니다.

우리는 도움이 필요한 외국인을 위해 매달 1회 행사를 계속 진행할 예정입니다. 앞으로는 한국의 의료전문가들의 도움을 받아 무료의료지원을 하는 프로젝트를 계획하고 있습니다. 이를 위해 우리에게 도움을 주고자 하는 모든 사람들을 초대해서 취지를 설명하고, 국적을 초월해 사회문제해결에 도전하는 프로젝트를 계속 만들어 갈 것입니다. 우리는 한국처럼 놀라운 나라에 살고 있는 모든 외국인들이 행복하게 체류하고, 잊을 수 없는 많은 추억들을 만들어 가길 바랍니다.
